The Patriot Act and the 2012 Reauthorization (I think it was 2012) makes "terrorism" a whole different thing than drug law enforcement, even when gangs are involved in drugs. And in my view, not all of that is in alignment with how I'd like the Constitution to be understood, but it's the law, and seems to give extraordinary latitude to the executive branch once that magic word is invoked. As does the cited law, despite it's age. We'll see how the case plays out for the five plaintiffs, who were not deported, and whether going forward POTUS needs permission to take decisive action to repel invaders, and maybe even what constitutes a foreign invader. The world of conflict in the era of organized terrorism is an asymmetric one (meaning it's often fought against organized non-state actors who may or may not be facilitated by states and may or may not use conventional military tactics).Does the “war on drugs” allow the president to do what he wants in contravention of the Constitution? There is no war, they don’t represent a foreign government, and the actions are on our soil.
